LICENSING SUB COMMITTEE 21ST NOVEMBER, 2005 Minutes of the meeting of the Licensing Sub Committee of Flintshire County Council held in County Hall, Mold, Flintshire on 21st November, 2005. PRESENT: Councillor L.A. Sharps (Chairman) Councillors A.G. Diskin and M.G. Wright. OFFICERS OF FLINTSHIRE COUNTY COUNCIL County Secretary, Licensing Manager and Principal Administration Officer. 1. DECLARATIONS OF INTERESTS None were received


2. REPORT OF THE DIRECTOR OF ENVIRONMENT AND REGENERATION The Sub Committee considered the report of the Director of Environment & Regeneration which was presented by the Licensing Manager, in respect of an application for a premises licence for the Uneeque Pizza, 73 High Street, Connah’s Quay.


3. THE APPLICATION - Uneeque Pizza, 73 High Street, Connah’s Quay. An application for a premises licence was made by Mr. Abbas Alghadban and Mr. Talal El-Arab for their hot food takeaway. The proposed hours for the provision of late night refreshment were as follows :- Sunday to Thursday - 11:00 pm to 1:00 am the following morning Friday and Saturday - 11:00 pm to 2:00 am the following morning Bank Holidays - 11:00 pm to 2:00 am the following morning New Years Eve - 11:00 pm to 2:00 am the following morning Christmas Eve - 11:00 pm to 2:00 am the following morning Friday to Monday at Easter weekend - 11:00 pm to 2:00 am the following morning


4. BACKGROUND The application was advertised in the required manner.


5. PROMOTION OF LICENSING OBJECTIVES The steps intended were: (1) Prevention of crime and disorder - C.C.T.V. in the shop which operated during all opening hours (2) Prevention of Public Nuisance - signs were displayed in the shop asking customers to keep the noise down


6. REPRESENTATIONS BY RESPONSIBLE AUTHORITIES Representations had been received from North Wales Police and were shown as Appendix 1 to the report.


7. NOTICES AND SUPPORTIVE DOCUMENTATION The Licensing Officer confirmed that all relevant notices and supporting documents had been issued.


8. SUBMISSION OF DOCUMENTORY EVIDENCE / REQUEST TO CROSS EXAMINE The Chairman asked the questions as determined in the procedure :- (a) The applicants confirmed that they had no additional information to submit (b) All parties requested the opportunity to cross-examine, if necessary. The Sub Committee agreed to the request of the parties to cross examine.


9. HEARING AND DETERMINATION OF THE APPLICATION The Chair advised that the Sub-Committee would proceed to hear and determine the application by reference to the four Licensing Objectives and each party would be granted up to 20 minutes to exercise their rights.


10. FURTHER INFORMATION The Chairman asked the Licensing Officer to confirm whether or not there was anything further to add to the papers in front of the Sub-Committee. He confirmed that there was not.


11. DETERMINATION OF APPLICATION The Chairman adjourned the proceedings and asked all to leave with the exception of Committee Members, County Secretary and the Clerk.


11. PRESENTATION BY APPLICANT Mr. Talal El-Arab presented the application and advised that this was a late night takeaway and to compete with other businesses he required the extra opening hours. He confirmed that a number of licensed premises would be open later and he needed his business to be open when they closed. He indicated that an additional hour would make a considerable difference to his turnover and he required the income to pay his staff wages. The Chairman sought clarification from Mr. El-Arab if they was anything further he wished to add and he confirmed that there was not at this stage.


12. DECISION The Sub-Committee agreed that the Application for the Licence, as submitted, be granted with the following terms and conditions (1) Provision of Late Night Refreshment Sunday to Thursday - 11:00 pm to Midnight Friday and Saturday - 11:00 pm to 12:30 am the following morning Bank Holidays - 11:00 pm to 12:30 am the following morning Christmas Eve - 11:00 pm to 12:30 am the following morning New Year’s Eve - 11:00 pm to 1:30 am the following morning Friday to Monday at Easter Bank Holiday - 11:00 pm to 12:30 am the following morning (2) Conditions C.C.T.V. recordings must be retained for 28 days for examination by the Police upon request.


12. REPRESENTATIONS BY RESPONSIBLE AUTHORITIES NORTH WALES POLICE Sgt. Colin Jones presented the evidence on behalf of North Wales Police. Sgt. Jones felt the premises should close no later than midnight on Sunday to Thursday and 12:30 am on Friday and Saturday. He indicated that the locality in question could be the subject of drunken or anti-social activity. He further indicated that takeaway outlets could often be a gathering point for persons responsible for such behaviour and that the premises in this application sought to remain open to the public at times when many public houses were closing. Sgt. Jones was aware from the application that C.C.T.V. was in operation at the premises but this should be added as a condition in any licence granted. Sgt. Jones confirmed that there had been no recorded incidents at the actual premises but his concern related mainly to the anti-social behaviour in and around High Street and felt that the hours requested by the applicant could exacerbate those problems.


13. REASONS In accordance with the recommendations of the North Wales Police. Approved Date Licensing Sub Committee – 21.12.05(Uneeque Pizza) - 1123 -


13. REPRESENTATIONS BY INTERESTED PARTIES Attached as Appendix 3 to the report was a letter from a resident who had expressed concern regarding the proposals for an extension of hours and this was noted by the Committee


14. FINAL PRESENATIONS / QUESTIONS (a) APPLICANT Mr. El-Arab suggested that as his was a pizza takeaway business it attracted different clientele and understood that other nearby premises were opening later and hoped that he could have the same chance as them to operate his business. (b) RESPONSIBLE AUTHORITIES North Wales Police Sgt. Jones reiterated his previous comments and in particular the condition relating to C.C.T.V.
