LICENSING SUB COMMITTEE 12TH SEPTEMBER, 2005 Minutes of the meeting Licensing Sub Committee of Flintshire County Council held on Monday, 12th September, 2005 in County Hall, Mold, Flintshire. PRESENT: Councillor J.J. Griffiths (Vice Chairman in the Chair) Councillors P. Walkden and D. Wisinger OFFICERS OF FLINTSHIRE COUNTY COUNCIL Principal Solicitor, Licensing Manager and Principal Administration Officer. RESPONSIBLE AUTHORITIES - REPRESENTATIVES No representatives were present. APPLICANT/AGENTS Ms. J. Blewitt, Counsel for the applicant, Mr. Mantache, Manager, and Mr. Watson, Licensee.


1. DECLARATIONS OF INTEREST There were no declarations of interest.


2. INTERESTED PARTIES None were present.


3. REPORT OF THE DIRECTOR OF ENVIRONMENT AND REGENERATION The Sub Committee considered the report of the Director of Environment & Regeneration which was presented by the Licensing Manager in respect of an application for a Premises License for The Red Lion, High Street, Northop.


4. PROMOTION OF LICENSING OBJECTIVES The steps proposed by the Company were attached as Appendix 1 to the report and a guide to Mitchells and Butlers policies were shown as Appendix 2 to the report.


4. THE APPLICATION – The Red Lion, High Street, Northop An application for a Premises Licence (conversion and variation) was submitted by Freemans Solicitors on behalf of Mitchells and Butlers Leisure Retail Limited. The premises was described as a managed business and local community pub. It has two trading areas to the ground floor. The premises currently operated to the standard hours of 11.00 am to 11.00 pm on Monday to Saturday and noon to 10.30 pm on a Sunday. The premises also held a Section 68 Supper Hour Certificate allowing it to sell alcohol ancillary to food until midnight on weekdays and 11.30 pm on Sundays. Recorded music or live music by a single performer or two performers together is permitted by the Licensing Act 1964, Section 182 dispensation. The hours proposed for the sale of alcohol are 10.00 am to midnight seven days a week, with a closing time 30 minutes later. An additional hour was proposed at Bank Holidays, Saints Days and at the Christmas period and in relation to recognised international sporting events. Regulated entertainment in the form of films, indoor sporting events and late night refreshment is proposed until midnight. The licensee was Mr. Kevin Power.


5. NOTICES AND SUPPORTING DOCUMENTATION The Licensing Officer confirmed that all relevant notices and supporting documents had been issued.


6. ATTENDANCE BY INTERESTED PARTIES At the commencement of the meeting representatives of the interested parties were not present. The Chairman allowed a ten minute period to see if they were likely to be present but they did not attend. The Sub Committee agreed to proceed with consideration of the application.


7. SUBMISSION OF DOCUMENTARY EVIDENCE/REQUEST TO CROSS EXAMINE The Chairman asked the questions as determined in the procedure:- (a) The applicants confirmed that they had no additional information to submit. As there were no other parties present it was not necessary to formally seek authority to cross examine but it was indicated that the Sub Committee members may wish to ask questions.


8. HEARING AND DETERMINATION OF THE APPLICATION The Chair advised that the Sub Committee would proceed to hear and determine the application by reference to the four licensing objectives and that each party would be granted up to twenty minutes to exercise their rights.


9. FURTHER INFORMATION The Chairman asked the Licensing Officer to confirm whether or not there was anything further to add to the papers in front of the Sub Committee. He confirmed that there was not.


10. PRESENTATION BY THE APPLICANT In presenting the application Ms. Blewitt referred to the comments of the interested parties and the fact that there was no evidence to support those claims. She referred to the fact that North Wales Police had not objected to the proposal and were not in attendance which she suggested they would be if there were problems. She commented upon the thrust of Government legislation relative to licensing and the strict review system if the objectives were not adhered to. She referred to the fact that the Manager had recently been appointed and the premises was predominantly a food outlet. It was confirmed that if the full extensions were granted it would not necessarily mean that the premises would be open all those hours but that it would just give a degree of flexibility to meet the demands of local businesses and local people generally. Members referred to the letters of the interested parties and particularly the reference to fireworks and it was confirmed that this was not an activity which had been promoted at the premises. The Chairman enquired of the arrangements made to encourage people to leave the premises quietly and in this respect Mr. Mantache confirmed that it would also be in his benefit for the clientele to leave quietly as he and his young family lived on the premises. The Principal Solicitor referred to that section on non standard timings for supply of alcohol and the significance of Temporary Event Notices.


11. FINAL PRESENTATION Ms. Blewitt in making the final presentation reiterated the thrust of her earlier comments and specifically the intention for the premises to be run in a professional manner without causing disturbance to nearby residents.


12. DETERMINATION OF THE APPLICATION The Chairman adjourned the proceedings and asked all to leave with the exception of Committee Members, Principal Solicitor and Clerk.


13. DECISION The Sub Committee agreed that the application for the licence as submitted be granted as follows:- (i) Supply of Alcohol and Regulated Activities Monday to Sunday - 10.00am to midnight (ii) Opening Hours Monday to Sunday - 10.00am to 12.30am the following morning (iii) Non Standard Timings On the following specified dates one additional hour is permitted for licensable activities with the premises closing 30 minutes after:- 1st January - New Year’s Day 1st March - St. David’s Day 17th March - St. Patrick’s Day Easter Sunday Easter Monday Sunday before first May Bank Holiday May Bank Holiday (first) Sunday before second May Bank Holiday May Bank Holiday (second) Sunday before August Bank Holiday August Bank Holiday 31st October - Halloween 24th December - Christmas Eve 26th December - Boxing Day 27th & 28th December 30th December (iv) International Sporting Events Temporary Event Notices must be submitted in respect of these occasions as and when they arise.


14. REASONS (i) The nature and size of the premises and the intention for it to be mainly a food outlet. (ii) No recorded complaints from Environmental Health and North Wales Police. Approved Date - 1079 -
