LICENSING SUB COMMITTEE 9TH OCTOBER, 2006 Minutes of the meeting of the Licensing Sub Committee of Flintshire County Council held in County Hall, Mold on Monday, 9th October, 2006. PRESENT: Councillor L.A. Sharps (Chairman) Councillors: S.R. Baker and J.F. Jones OFFICERS OF FLINTSHIRE COUNTY COUNCIL Solicitor (Mr. Damian Gaskell), Licensing Officer and Administration Assistant. RESPONSIBLE AUTHORITIES - REPRESENTATIVE None were present. APPLICANT/AGENTS John Edwards, the Licence Holder


1. APOLOGIES None were received.


2. DECLARATIONS OF INTEREST (Including Whipping Declarations) None were received.


3. REPORT OF THE DIRECTOR OF ENVIRONMENT AND REGENERATION The Sub Committee considered the report of the Director of Environment & Regeneration which was presented by the Licensing Officer in respect of the application received to vary a premises licence at Hawarden Institute.


4. THE APPLICATION – HAWARDEN INSTITUTE An application for a variation of a premises licence was made by Hawarden Institute. The premises currently held a licence for the sale of alcohol from 11.00 am to 11.00 pm Monday to Saturday and noon to 10.30 pm on a Sunday. Regulated entertainment was permitted between the hours of 9.00 am and midnight, Monday to Saturday. The proposed hours for sale of alcohol were:- Sunday to Thursday - 11.00 am to 11.00 pm Friday & Saturday - 11.00 am to 1.00 am the following morning New Years Eve - 11.00 am to 11.00 am the following morning Bank Holiday weekends - One hour extra The proposed hours for Plays, Films, Indoor Sporting Events, Boxing or Wrestling entertainment, Live music, Recorded Music, Performances of Dance, anything of a similar description of Live Music, Recorded Music and Performances of dance, Facilities for making music and Facilities for dancing and provision of facilities for anything of a similar description were:- Sunday to Thursday - 9.00 am to Midnight Friday and Saturday - 9.00 am to 1.00 am the following morning New Years Eve - 9.00 am to 2.00 am the following morning Bank Holiday weekends - One hour extra The proposed hours for Late Night Refreshment were:- Sunday to Thursday - 11.00 pm to Midnight Friday and Saturday - 11.00 pm to 1.00 am the following morning New Years Eve - 11.00 pm to 2.00 am the following morning Bank Holiday weekends - One hour extra The proposed opening times of the premises were:- Sunday to Thursday - 9.00 am to Midnight Friday and Saturday - 9.00 am to 1.30 am the following morning New Years Eve - 9.00 am to 9.00 am the following morning Bank Holiday weekends - One hour extra


5. PROMOTION OF THE LICENSING OBJECTIVES The additional steps proposed by the applicant were attached as Appendix 1 to the report.


6. NOTICES AND SUPPORTING DOCUMENTATION The Licensing Officer confirmed that all relevant notices and supporting documents had been issued. Representations were received from persons living in the vicinity and were attached as Appendix 2 to the report.


7. SUBMISSION OF DOCUMENTARY EVIDENCE/REQUEST TO CROSS EXAMINE The Chairman asked the questions as determined in the procedure:- (a) The applicant confirmed that he had no additional information to submit. (b) The applicant requested the opportunity to cross examine, if necessary.


8. HEARING AND DETERMINATION OF THE APPLICATION The Chairman advised that the Sub Committee would proceed to hear and determine the application by reference to the four Licensing Objectives and advised the applicant that he would be granted up to 20 minutes to exercise his rights.


9. PRESENTATION BY THE APPLICANT The Chairman invited the applicant, Mr. John Edwards, to present his case. Mr. Edwards explained that the primary reason for requesting variation to the premises license was that he had to pay £21 to Flintshire County Council for each extension application. He added that he had always been granted the application for extra hours when this had been requested. Mr. Edwards said that he refuted the statement regarding unsupervised children in the first letter of objection as the manager of the Institute ensured that children were supervised. The second part of the letter stated that the doors were left open during the hot weather, but he said that the doors had only been left open on one occasion. He explained that he was keen to work with residents and said that the first objector was a member of the Institute Committee and that she had not raised the issue at Committee. He added that the Institute was limited to 52 functions per year and had so far only had 8 this year. He felt that an extension on a Friday and Saturday night may generate more business.


10. FINAL PRESENTATIONS (a) Applicant Following a question from a Member regarding the time stated in the first letter of objection for serving of alcohol, the applicant said that this was an error and alcohol was only served until 11.00 pm. He added that there may have been a misunderstanding of the notice served. Mr. Edwards said that no objections had been received from the Police and that the Institute had a very responsible Management Council. He explained the position of the objectors’ properties in relation to the Institute. He added that the properties across the road from the Institute were closer and no objections had been received from these residents.


11. DETERMINATION OF THE APPLICATION The Chairman adjourned the proceedings and asked all to leave with the exception of the Committee Members, Solicitor and the Clerk.


12. DECISION The Sub Committee agreed to all aspects of the application but with a condition that the doors remain closed at all times.
