Conduct and Convictions of a Private Hire / Hackney Carriage (Joint) Driver

Decision:

That the Sub-Committee agreed that the applicant is a fit and proper person to continue as a Private Hire Driver licensed by Flintshire County Council but that a probationary period of six months be applied to the licence. 

 

Minutes:

The Chairman welcomed the applicant, introduced the Members of the Sub-Committee and explained the procedure for the hearing.

 

The Licensing Officer introduced a report, the purpose of which was for Members to consider relevant convictions of a Private Hire/Hackney Carriage (Joint) Driver Licence and to determine whether the applicant remained a fit and proper person to hold such a licence within the meaning of the Local Government (Miscellaneous Provisions) Act 1976. 

 

The Chairman invited Members of the Panel to ask questions.  The applicant responded to the queries raised by Members and confirmed that he understood his responsibilities as a private hire/hackney carriage driver. 

 

When the Chairman was satisfied that the Panel had asked the applicant and the Senior Licensing Officer all relevant questions he asked the applicant, the applicant’s representative and the Officer to leave the meeting whilst the Sub Committee made their decision. 

 

 

 

 

Determination of the Application

 

            The Sub-Committee considered the application including both written and oral representations made by the applicant, the applicant’s representative and the Licensing Authority.

 

            The Sub-Committee agreed that the applicant could retain a Private Hire/Hackney Carriage (Joint) driver’s licence but that a probationary period of six months should apply and that any breaches of the licence or the law could result in the suspension or withdrawal of the licence.

 

Decision

 

            The Senior Licensing Officer, the applicant and the applicant’s representative were invited to return to the meeting.

 

            The Chairman reminded the applicant of the seriousness of failing to report the convictions to the Licensing Authority.  He advised the applicant that he could retain a Private Hire/Hackney Carriage (Joint) driver’s licence but that a probationary period of six months would be applied to the licence and that any breaches of the licence or the law would result in the applicant being called before the Sub-Committee again and could result in the suspension or withdrawal of the licence.  The Chairman confirmed that the applicant would not be required to complete another CRB or DVLA check at the end of the six month probationary period.
