Decision:

That the press and public be excluded from the meeting for the following items as they were considered to contain exempt information by virtue of paragraphs 12 and 13 of Part 1 of Schedule 12A of the Local Government Act 1972 (as amended).

Application for a Personal Licence

For Members to consider and determine an application for a Personal Licence

Decision:

That the application be refused.

Minutes:

The Licensing Officer introduced the report which was for consideration of an application for a Personal Licence.

 

The applicant had been convicted of a motoring offence in 2013, full details of which were outlined in the report.  The offence was a relevant offence under the Licensing Act 2003 and was therefore referred to North Wales Police.

 

            The Police, as a Responsible Authority, could take the view that an applicant who had been convicted of one or more of the relevant offences listed in the Licensing Act 2003 may undermine the licensing objectives and that the offence may not be compatible with the duties and responsibilities of a prospective Designated Premises Supervisor.

 

            The representative of North Wales Police provided full details of the offence and outlined the reasons for the Objection Notice.         

 

            The applicant and his companion were invited to address the Sub-Committee and they provided reasons as to why they felt the application should be supported.

 

            The Members asked questions of both the applicant and his companion to which they responded.

 

            DETERMINATION OF THE RECOMMENDATION

 

The Sub-Committee considered the report and the details provided verbally at the meeting by the applicant and his companion, the Licensing Officer and the representative from North Wales Police.

 

Following careful consideration of all of the information and evidence provided, the Sub-Committee were all of the view that if the application was granted, the licensing objectives would be undermined and therefore the application was refused.

 

            DECISION

 

The Licensing Officer, the applicant and his companion were invited to return to the meeting.

 

The Chairman advised that, in consideration of the written and oral evidence, the Sub-Committee were of the view that the licensing objectives would be undermined due to the applicant’s impaired judgement and therefore the application was refused.

 

RESOLVED:

 

That the application be refused.
