For Members to consider and determine an application for a Private Hire / Hackney Carriage (Joint) Driver Licence

Decision:

That a private hire / hackney carriage (Joint) driver licence not be granted.

Minutes:

The Senior Licensing Officer introduced the report which was for Members to consider and determine an application for a Private Hire / Hackney Carriage (Joint) Driver Licence.

 

                        The report provided details of convictions of the applicant which had been omitted from the application.  Members asked questions on the convictions to which the applicant responded.

 

The Solicitor explained that Members needed to determine if, on the balance of probability, the driver was a fit and proper person to continue to hold a licence.

                       

            DETERMINATION OF THE RECOMMENDATION

 

The Sub-Committee considered the report and the details provided verbally at the meeting.

 

Following careful consideration of all of the information and evidence provided, the Sub-Committee were all of the view that, on the balance of probability, the driver was not a fit and proper person to hold a private hire/hackney carriage (joint) driver’s licence. 

 

            DECISION

 

The Senior Licensing Officer and the applicant were invited to return to the meeting.

 

The Sub-Committee heard all of the representations made, both written and verbal. The Sub-Committee had an overriding duty to protect the public and determined that the applicant was not a fit and proper person to hold a private hire / hackney carriage (Joint) driver licence.

 

The applicant had prolific convictions, the most recent being in 2008 and although the Sub-Committee noted the explanations of those convictions, they still had great concerns, including his account of the way he handled the incident that resulted in him committing the violent offence for which he was convicted.  The Sub-Committee considered and applied paragraph 4.22 of Flintshire County Council's Policy in respect of Hackney Carriage and Private Hire Drivers' Licence Applications concerning the treatment of convictions etc.

 

RESOLVED:

 

That a private hire / hackney carriage (Joint) driver licence not be granted.
